CatsandProsecco
Hey everyone, I was wondering if anyone was willing to share their input/advice regarding a new grad derm offer... Pros: Dream Speciality, 95k starting salary, 1 year training program. Great benefits Cons: Relocating. *3 year contract. If breach contract and leave <1 year, I owe the entire years salary back to the practice (95k~!); if I leave after 1 year but before 3 years, I owe 50k. I was wondering..is this pretty standard? I know it is extremely difficult to break into this speciality, let alone as a new grad; but this seems financially unsafe/risky... Thank you for your advice!! Moderator ventana Posted April 20, 2022 Moderator Share Posted April 20, 2022 Load of poop. huge red flag that it is a toxic abusive practice when they put penalties on it like that.
CatsandProsecco
@ventanaThank you for your response. I was surprised to hear this during the interview. I had to ask him to break it down and explain it to me. I had heard about some urgent cares doing this, but way less of a penalty-closer to the 5-10k ballpark. Bummer! Moderator EMEDPA Posted April 20, 2022 Moderator Share Posted April 20, 2022 Non-compete clauses are more common like " you can't work in derm within 100 miles of here for 2 years if you leave".
sas5814
Pay back your salary? No way. No how I have seen some crazy things in non-competes but that is a new one. 1 1

TeddyRucpin
Terrible all around. I'm surprised you are seriously considering this. The sad thing is when you drop it, some sucker will take it.
Reality Check 2
Sounds like this practice has had PAs use it as a training ground to move on to better places. Thus, the stupid "pay back your salary" clause - sounds like no one wants to stay. Red Flags flying and crap salary to boot. RUN
iconic
I’m pissed at the legal profession that has created the working environment for healthcare workers that they themselves would never work under
EastCoastPA
Is that even legally enforceable?

Dunno.. but I was a victim of a (nowhere anywhere as bad) predatory employment contract. Most of them also have arbitration clause (that is the employer can take you to arbitration which is done through a private company of their choice which can issue judgements against you). I think you could file for bankruptcy, but to some extent these contracts are enforceable and you cannot even request a trial through arbitration

I always think the next thing tops it with the offers we see on this forum but this takes the crown for now. Run, don’t walk, from this. I’m not even sure how they legally put that in their contract. kettle
Obviously from the statements above this is not common for a contract. Also guessing that they would want the full 95k back and not the actual amount you received after taxes. Derm is a desirable specialty for PA's and this employer is exploiting that. Any job I'm serious about I have an attorney read over the contract.
sas5814
you could tell them you want an "asshat" clause. If you leave because they are asshats they owe you 250k. You can use a mediator to decide. I need more coffee 1

trazodone
This is the worst contract I have ever seen on this forum. How could they make you pay your entire salary back? That is bordering on criminal. I would let the employer have it verbally. This is abusive and unconscionable.
