nycpa77
Hi all, im wondering if others have insight into this- I’ve been told conflicting things. Can a PA be paid a percentage of first assist fees? I’ve been told it could be considered fee-splitting, but it doesn’t seem to be that when I read the law (but I’m not a lawyer...). I cannot get a straight answer on the legality. I know plenty of people that do it, but am wondering if making it a “bonus” is legal or not. Any insight, especially if New York-related, would be helpful. Thank you! Arthropathy
I'm not a lawyer. Fee splitting, as I understand it, is a kickback. Cash for referrals. You earning a percentage of revenue you generated does not qualify.
AbeTheBabe
I get paid 10% of collections as a bonus every quarter, and that includes first assist fees. This is a large and well established practice. If it was illegal, trust me they would not be including it in my bonus every quarter, that's the perfect excuse.
