In Washington State, the expectations are clearly spelled out in the practice agreement: If DOH has signed off on your practice agreement saying telephone consultation is fine, then you're good to go. Not the practice or physician. I'm surprised that this comes up as much as it does. I'm starting to understand C. Eastwood's character in Gran Torino more and more.
