The basic rule to keep yourself out of medical trouble is pretty straightforward:

 

Never lie.

 

Ever.  For any reason.  So, if you discussed them with the doctor before you write your note, you can say you discussed them with the doctor in your note.  Otherwise, you're lying, and opening yourself up to major medicare fraud penalties.
