swimchik04
Thoughts on this non-compete clause for an ortho job that I was offered? To me, it seems like the way that it is currently written would restrict me from working in any specialty for 12 months...
crossbone2007
Yep! Restricting you from seeing any of their patient for 12 months after termination of employment regardless of speciality you choose to work in thereafter. I wouldn't sign unless the language is changed. The restriction is too broad as well. Sent from my Nexus 5X using Tapatalk
mgriffiths
I definitely don't speak or read "legalese," but that comes across to me as more that you can't steal patients if/when you leave the practice. In other words, you can tell patients you are leaving, but you can't tell them that you are going to the competition that is just down the road. I did not read that as meaning you can't see their patients for 12 months if they just show up to your new place of employment. But, I would definitely want a third party to interpret that for me to make sure, and then corroborate with the practice itself.
Moderator LT_Oneal_PAC Posted February 15, 2017 Moderator Share Posted February 15, 2017 I would definitely have solicitation defined.
SCPA
that is a non solicitation clause -- don't steal patients when you leave -- not really a non-compete, which typically states you can't work within x amount of miles from this practice (because we're afraid your patients will follow you). .. that wording is less restrictive than a non compete and It wouldn't bother me much. you can see patients at any time after leaving, in any specialty, as close to the practice as you want, as long as you don't bring patients with you is how that reads to me... which is reasonable.
