Hi!  quick question, I am filling out my forms to confirm acceptance, and on the background check form it says to list all convictions.  I had a speeding ticket 8 years ago, I don't know if that means I was convicted for speeding.  Does anyone know?

Now I need to check my driving record because I've paid a "unlawful passing through a solid white line (horribly timed, everyone does it at that area but a cop passed me at that exact time so had to stop)". Not sure how correct that website is though.

lol!  Ok I tried to log back in and the server is down... but I swear I remember reading < felony, misdemeanor, etc, including speeding tickets> as what is written.  I am sure a speeding ticket from 8 years ago isn't a big deal, but I am trying to be honest.  I will paste the exact verbiage on here later when the site is back up!

lol guys, these are not felony convictions

 

 

Ah, I haven't actually looked at the bg check form yet so I missed the Felony conviction part. Yeah, the traffic tickets don't apply.

I think this is the first time I've ever seen this question include motor vehicle violations. Part of me wish I fought it in court (the cop even told me to and that she wouldn't even show up) but I was busy with work and just paid it.

 

I'm sure it won't hurt us being accepted though and include it since they'll see regardless with a background check.

What are misdemeanor and felony moving violations?

 

The majority of moving offenses are infractions — minor traffic offenses that are kept within the jurisdiction of the traffic courts. But some traffic violations may be prosecuted in the criminal courts as either misdemeanors or felonies, depending on the severity of the crime.

 

Felonies represent the most severe crimes, while misdemeanors are between infractions and felonies. Felonies and misdemeanors, unlike infractions, can result in heavy fines, loss of driving privileges, and, in some cases, imprisonment. Each state handles these classifications differently.

 

 

We may be good because it's not an actual "misdemeanor"? Lol I'm starting to think we are reading too much into this.

It depends on the state what qualifies as a misdemeanor. I listed everything ,which isn't that much, I thought might show up. I am not trying to hide anything

Hey Guys,

Regarding Speeding tickets, it is considered a misdemeanor and when I sent my application in Last year i put mines on their.  This is by no means a reason for rejection however, not putting can be perceived as "lying" and that is something you dont want to deal with. 

As for as net I.D. you will get those mid next year around April I believe and would allow you to access your duke portal - Wendy would send out an email when those are sent - however they would come from Duke IT itself and not Wendy so look out for that.

I politely disagree about the Speeding Tickets being a Misdemeanor issue. That's just, well, it's not legally accurate. The vast majority of traffic citations are simply "infractions", not Misdemeanors.

 

Put it this way, an infraction might cost you a small fine and points on your driving record. A Misdemeanor or Felony are potentially jailable offenses that can go to trial by jury. To that extent, most courts have separate County Traffic Courts for the minor citations like speeding (a moving violation) or parking tickets (a non-moving violation).

 

Misdemeanors and Felonies, on the other hand, are seen in Criminal Court. They're a totally different ballgame that can result in the individual serving jail time in a local, state, or federal jail. Misdemeanors require smaller fines and shorter jail times. They're lesser offenses. Felony offenses have large fines and extended jail times, and loss of rights to things like voting and gun ownership, and also preclude licensure for many professional organizations.

 

Of note: drug offenses can often preclude students from being eligible for federal financial aid sources.

 

 

Some Examples:

 

Traffic Infraction:

- Minor Speeding

- No Blinkers when Passing

- Broken Tail Light

- Failing to Stop at Light/Stop Sign

- Parking In a No-parking Zone

- Expire Parking Meter

 

Misdemeanor:

- First DUI

- Possession of Marijuana, etc

- Reckless Driving

- Failure to Stop at an Accident

- Shop-Lifting

- Minor in Possession of Alcohol

 

Felony:

- Vehicular Manslaughter/Homicide

- Severe Hit & Runs

- Repeat DUIs

- Drug Distribution

- Attempted Rape/Rape

- Assault with a Deadly Weapon

- Attempted Homicide

- Homicide
